     This ACT Supreme Court case before Mr Justice Fox was heard on 16 Feb 1972, 17 Feb 1972 and 28 Feb 1972 and reported in the Canberra Times on the following days. The text that follows is an edited version of the Canberra Times reports. $18,000 in 1972 equates to approximately $100,000 in 2013.

     Mrs Annie Jean Emerson- Elliott (AJD), of Wilkins Street, Mawson, claimed $18,000 from Mr Leslie Dennis [sic] Emerson-Elliott (LDEE), of London Circuit, Canberra City. AJD was represented by Mr J. Gallop and LDEE was represented by Mr A. S. Gillespie-Jones and Mr P. Sheils, instructed by Mr D. St John Emerson-Elliott.
     AJD said in evidence she had first met LDEE, the proprietor of a firm known as Real Estate and Finance Corporation of Canberra, in December 1968, when she had been in the market for a home in Canberra. She had then been a widow for about 10 years. An association had developed from that business transaction and in August 1969, they had discussed marriage.
     During the ensuing period there had been an exchange of confidences about their respective financial positions. LDEE had told her that he had been in financial difficulties and that his bank account had been overdrawn. He had said that the deficiencies had resulted from fraud by an employee. LDEE had mentioned that $10,000 had been owing to the bank. This amount had been increased to more than $15,000.
     AJD said their wedding date had been fixed for 29 October 1970, and subsequently LDEE had indicated that more than $17,000 had been owing to the bank. She had agreed to lend him the money for the purposes of his business and had made out a cheque for $18,000 which she had given to him on 22 October 1970.
     They had been married on 29 October 1970.
     After their marriage LDEE had indicated from time to time that he was not in a position to repay the loan. AJD said she had not pressed for repayment because she had believed he could not afford to repay her. Matrimonial difficulties had arisen and they had separated. None of the $18,000 had been repaid.
     In cross-examination, AJD said she had been shocked to learn that her husband had not been indebted to the bank. She agreed that he had given her a cheque for $10,000 but he had told her not to cash it because there had been no funds in the bank.

     In his evidence the following day, LDEE, of Haddon Street, Hackett, said that a cheque for $18,000 he had received from his wife had been a gift because she had wanted to get married. She had told him she would not mention it to anyone and did not want him to mention it. He said the money had not been lent to him and denied that he had ever been indebted to his bankers. He had never told his wife that he owed money to his bankers and that he had been pressed for payment.
     About 28 August 1970, he had drawn a cheque for $10,000 in favour of his wife and this represented half the cost of the matrimonial home at Mawson. LDEE said it had been mutually agreed that he pay this amount as he had been reluctant to live in the house and his wife had thought that if he had a half share in it, he would not feel so bad about it. She had later told him that she had torn the cheque up and he had felt very hurt and upset.

     After an adjournment to 28 Feb 1972, Mr Justice Fox said that the sum of $18,000 paid by AJD to her husband shortly before their marriage was a loan and not a gift. He entered judgment for $18,000 plus costs in favour of AJD against LDEE.
