This is the address where CWB was born on 25 Feb 1887, although the mother gave her address then as Melbourne. During the period after CJB deserted his wife (see explanation in Divorce tag), she perhaps stayed in Melbourne for a while, and then moved to Castlemaine (which is close to Maldon, where she was born and perhaps where her parents still lived) for the birth. It is not known when she returned to Melbourne, although she was living in Fitzroy when she petitioned for divorce in 1893.8

BATTEN V. BATTEN.
Marian Batten, of 138 Gore street, Fitzroy, petitioned for a divorce from her husband, Charles John Batten, of Chancery lane, clerk, on the ground of desertion. The petitioner's story was that prior to the marriage in the year 1886, she lived as a companion in the service of the respondent's mother, at East St Kilda, and that the respondent seduced her, she being then 21 years of age and he somewhat younger. His parents forced him to marry her, and the marriage took place at a registry office in Carlton on 20 October 1886. He remained with her for one day, and then told her that he would have nothing more to do with her. When her child was born in the following February, he sent her £1, and for some time paid her 10s. a week, but he steadily refused to give her a home.
Mr. MacHugh, instructed by Mr. F. S. Stephen jun , appeared for the petitioner.
The Chief Justice granted a decree nisi, with costs, remarking that this appeared to be one of those lamentable instances where a man showed not only that he was a rascal, but how keen a rascal he could be.10

This is the address where CWB was born on 25 Feb 1887, although the mother gave her address then as Melbourne. During the period after CJB deserted his wife (see explanation in Divorce tag), she perhaps stayed in Melbourne for a while, and then moved to Castlemaine (which is close to Maldon, where she was born and perhaps where her parents still lived) for the birth. It is not known when she returned to Melbourne, although she was living in Fitzroy when she petitioned for divorce in 1893.7

BATTEN V. BATTEN.
Marian Batten, of 138 Gore street, Fitzroy, petitioned for a divorce from her husband, Charles John Batten, of Chancery lane, clerk, on the ground of desertion. The petitioner's story was that prior to the marriage in the year 1886, she lived as a companion in the service of the respondent's mother, at East St Kilda, and that the respondent seduced her, she being then 21 years of age and he somewhat younger. His parents forced him to marry her, and the marriage took place at a registry office in Carlton on 20 October 1886. He remained with her for one day, and then told her that he would have nothing more to do with her. When her child was born in the following February, he sent her £1, and for some time paid her 10s. a week, but he steadily refused to give her a home.
Mr. MacHugh, instructed by Mr. F. S. Stephen jun , appeared for the petitioner.
The Chief Justice granted a decree nisi, with costs, remarking that this appeared to be one of those lamentable instances where a man showed not only that he was a rascal, but how keen a rascal he could be.9

The following summary traces the known movements of John Batten and his family. There are many gaps, some of which could probably be filled by acquiring BMD certificates.
     John Batten was born in London ca 1794/96. Jemima May was born in Camberwell, Surrey ca 1792/93. They were married on 17 Feb 1821 in the church of St Dunstan, Stepney, London.
     Their first child, son John Jnr, was born on 2 Nov 1821 in London and was baptised on 13 Jan 1822 in the church of St Dunstan, Stepney.
     The second child, son Charles, was born on 29 Mar 1823 in Shoreditch, London and was baptised on 11 May 1823 in the church of St Leonards, Shoreditch.
     The third child, son George, was born ca 1824/25 in London.
     The fourth child, daughter Jemima Jnr, was born ca 1827/28 in St George's East, London.
     The fifth child, daughter Ann, was born ca late 1829 in London and baptised on 13 Dec 1829 in the church of St Dunstan, Stepney.
     The sixth child, daughter Sarah, was born ca late 1831 in London and baptised on 1 Dec 1831 in the church of St Dunstan, Stepney.
     The seventh and last child, son James, was born ca mid-1834 in Stepney, London and baptised on 28 Sep 1834 in the church of St Dunstan, Stepney.
     On Census date 6 Jun 1841, the parents and 7 children, and Ann Batten (widow of John Snr's brother) and her son John all lived at 18 Arbour Street East, Mile End Old Town, Upper Tower Hamlets, London.
     On 27 Sep 1850, son John (of 4 Rodney Terrace West, Mile End Old Town) married Emily James (of Arbour Square, Stepney) in Trinity Church, Stepney. Their first 3 children were born around Stepney and North Aylesford, London. The family migrated to Victoria ca 1855.
     On Census date 30 Mar 1851, John Snr and Jemima, 5 of their children and Ann Batten were living at 4 Rodney Terrace, Mile End Old Town. It is not known where daughter Jemima or Ann Batten's son John were living.
     On Census date 7 Apr 1861, John Batten and 4 adult unmarried children (Charles, George, Ann and James) were living at 1 Aden Terrace, St Mary Stoke Newington. It is not known where John's wife Jemima or daughters Jemima and Sarah were living at that time, although wife Jemima was presumably only temporarily absent.
     About Aug 1861, son Charles and daughter Sarah both died. About May 1867, son George married and presumably moved out. In Nov 1867, son James married and presumably moved out. When John Batten died in Jul 1868, he was living at 5 Grange Road, Stoke Newington (presumably with wife Jemima and daughter Ann, and possibly daughter Jemima). Son George (and, presumably, his wife) were living at 66 Lower Thames Street, London.
     On Census date 2 Apr 1871, Jemima Batten and 2 adult unmarried daughters (Jemima and Ann) were living at 12 Clifton Road, Islington. Son George and his wife were at 14 Clifton Road. Son James and his wife and their eldest child had moved to Loughton, Essex, where their second child was born.
Jemima Batten died ca May 1876, and her death was registered in Islington.

(Witness) NoteAnn Elizabeth (Elizabeth) Batten;      Elizabeth Batten was probably born in 1836 or 1837 before the civil registration of births commenced. No baptismal record has been found for her.
     In these records, it has been assumed that Elizabeth was the daughter of Joseph and Elizabeth Batten (nee Bedwold) because:
     (a) that appears to have been the view through later generations of the family and that's how it has been recorded by the family and by other researchers;
     (b) that would be the normal inference from the 1841 Census record, although relationships are not stated explicitly in that Census; and
     (c) Elizabeth's 1857 Marriage Certificate (to Charles Rumens) shows her father as Joseph Batten, Carpenter.
     (d) Elizabeth's 1906 Marriage Certificate (to Alfred Green) also shows her father as Joseph Batten, Carpenter.
     However, another (more likely) possibility is that she was the illegitimate daughter of Sarah Batten and an unknown father and was, at least initially, brought up as the child of her grandparents Joseph and Elizabeth Snr. Factors supporting this are:
     (A) In the 1841 Census, Sarah (age 25) is, unusually, listed after her younger brothers and she is followed immediately by Elizabeth (age 4), suggesting the possibility of a mother/daughter relationship.
     (B) Also in the 1841 Census, Elizabeth Snr was shown as age 50, so that she would have been about 47 when Elizabeth Jnr was born -- it is very unlikely, although perhaps not impossible, that she would have had a child at that age.
     (C) In 1844, Sarah married Robert Morley and, in the 1851 Census record for Robert and Sarah, there are also entries for Betsy Morley (age 13) and Maria Morley (age 2), shown as the daughters of Robert Morley. However, Betsy is the same age as Elizabeth Jnr and, of course, Betsy is a common diminutive of Elizabeth. It seems unlikely that Robert Morley was Betsy's father as he would have been about 18 when she was born and Robert and Sarah did not marry until Elizabeth/Betsy was aged 6 or 7. It seems more likely that Elizabeth Jnr was brought into the marriage by Sarah, was adopted by (or at least took the name of) Sarah's husband and was known by the nickname Betsy at that time. Although there are quite a few other Elizabeth/Ann Battens of about that age in the 1851 Census, none of them seems likely to be Elizabeth Jnr.
     (D) In most of the Birth Certificates for Elizabeth Jnr's children, the mother's maiden surname is given as Batten. However, the 1862 Birth Certificate for Frances Sarah shows the mother's maiden name as Morley, which again suggests that Elizabeth Jnr had used the surname Morley at some stage.
     A third (very unlikely) possibility was that Elizabeth Jnr was the daughter of an incestuous relationship between Joseph Batten and Joseph's daughter Sarah. In that case, Joseph would have been both the father and grandfather of Elizabeth Jnr. [16 Oct 2011]
     The death certificate for Sarah Morley shows Elizabeth Rumens as the Informant. This does not seem to provide an indication one way or the other -- Elizabeth was either Sarah's daughter or only sister, and could have been the informant in either capacity. [22 Nov 2013]
     To reflect what I believe was the probable situation, I have included in Relation tags for appropriate family members the assumed relationship according to these records and also the probable alternative to show what might have been the real situation. [3 May 2014]

     Typhus fever (quite different from typhoid fever) is a bacterial infection spread by parasites, particularly body lice. A major epidemic occurred during the Great Irish Famine between 1846 and 1849 and this spread to England, where it was sometimes called "Irish fever" and was noted for its virulence. It killed people of all social classes, as lice were endemic and inescapable, but it hit particularly hard in the lower or "unwashed" social strata.
     Lice were not identified as the transmitter of typhus until the 1920s and it was only during and after WW2 that adequate treatment regimes were developed.30
